Terms of Service
The agreement for using Lifetime Remembrance.
These Terms of Service (“Terms”) govern your use of the Lifetime Remembrance website and services (the “Service”) provided by Lifetime Remembrance (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service.
2. The Service
Lifetime Remembrance is AI memorial technology that creates an interactive remembrance of a person from material you provide, including a synthesized version of their voice. Parts of the Service are in development or offered as a preview and may change.
3. Accounts
Some features require an account. Keep your credentials secure, and you are responsible for activity under your account. Notify us promptly of any unauthorized use.
4. Your content and the rights you grant
You may provide recordings, photographs, writings, and other material about a person (“Your Content”). You keep your rights in Your Content. You grant us a limited license to host, process, and use Your Content solely to create, operate, and improve the memorial and Service you request — including creating a voice and conversational profile of the person. You may ask us to remove Your Content, subject to our legal obligations.
5. Consent, authority, and likeness
This is important. By providing material about a person and asking us to create a memorial, you represent and warrant that you are either that person or their authorized representative (such as next of kin or an estate representative), and that you have all rights, consents, and authority necessary to provide the material and to create and use a voice and likeness of that person, consistent with applicable right-of-publicity, voice, and likeness laws. You will not use the Service to recreate the voice or likeness of anyone without that right and consent.
6. Acceptable use
You will not use the Service to do anything unlawful, infringing, deceptive, or harmful — including impersonating a person to defraud or mislead others, creating a memorial of someone without authority, or violating anyone’s rights.
7. The memorial is a simulation
A Lifetime Remembrance memorial is an artificial, AI-generated representation created from the material provided. It is not the actual person, is not conscious or sentient, and does not speak for the real person. Its responses are generated and may be inaccurate, incomplete, or unexpected. It is intended for remembrance, and not as a source of professional, legal, medical, financial, or other advice.
8. Intellectual property
The Service, our software, and the underlying technology (patent pending) are owned by us and our licensors. These Terms do not grant you any rights in them except to use the Service as permitted.
9. Fees
Where the Service or specific offerings are paid, the applicable prices and terms will be presented to you before purchase.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any memorial will meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, Lifetime Remembrance will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service.
12. Indemnification
You agree to indemnify and hold Lifetime Remembrance harmless from claims arising out of Your Content, your use of the Service, or your breach of these Terms — including the consent and authority representations in Section 5.
13. Termination
We may suspend or terminate access to the Service for any violation of these Terms. You may stop using the Service at any time.
14. Governing law
These Terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict-of-laws rules.
15. Changes
We may update these Terms. We will post the updated version here and revise the effective date. Continued use of the Service means you accept the changes.
